Did you know that your social media profile is admissible as evidence in a court case? It's true. Anything you post: images, content, quotes, or links are considered evidence in a court case. If you are involved in a personal injury case, you need to be conscious of what you are posting and who can see it.

Best practices regarding social media and your personal injury case:

  • Manually change the privacy setting to ensure your posts are not public.
  • Do not post about your court case, your health, your treatment, photos of yourself...just don't post anything personal.
  • Do not delete posts. Deleting a previous post is deleting evidence. Defendants can use these actions to discredit you in court.

Your lawyer will advise you on preserving digital information to be used in court, just make sure you advise your lawyer on your bull riding vacation last month before the defense produces a Facebook picture!
